Terms of Service

Welcome to Unistry! By accessing our platform, including but not limited to https://unistry.io, https://app.unistry.io and unistry CLI client, you are agreeing to be bound by these terms of service. References to our platform in this terms of service refer to all of our products and services, including our web app, CLI, and website. If you do not agree with any of these terms, you are prohibited from using or accessing our platform. 

 

Our Vision

Our vision is to be the go-to platform for the best command-line experience. 

 

If you’re seeking a secure, reliable and always available centralised command line history to manage and access your commands across devices and shells on demand, Unistry is the platform for you.

 

Use license

Permission is granted to use our products for as long as agreed on the day the authorisation was provided. Your allowed usage will vary based on your subscription and/ or our product’s description. This grant of a license IS NOT a transfer of title, and under this license, you may not:

  1. • attempt to circumvent any restrictions or limits placed on your resource thresholds (including but not limited to Auth Tokens) or account;
  2. • attempt to decompile or reverse engineer any product offered by Unistry;
  3. • remove any copyright or other proprietary notations from the materials;
  4. • authorise more than one person(s) access per account at any one time, unless authorised;
  5. • use our products for malicious intent;
  6. • use our products to handle unauthorised material in any way;
  7. • use the products in any manner that violates any laws directly or indirectly;
  8. • attempt to build a competing platform.

Unistry has the right to terminate, restrict the use of the platform, or to block users without giving reasons.

 

Data license

As part of our Unistry platform, Unistry CLI and Unistry Web App, we enable users to push and manage encrypted command data and its accompanying metadata sourced through Unistry’s proprietary technology. Command metadata collected contains no personally identifiable information regarding end users unless specified by the user, i.e. provided in the commit message, summary message, or as system hostname etc. As part of the Unistry products, data can be decrypted on the fly, and this will require the end-user to provide a private key which will enable in-memory decryption. Note any command data stored will only be decryptable by authorised person(s) with the respective private key paired with the public key(s) used to encrypt. The Unistry team WILL NOT be able to access your encrypted command data. The responsibility to look after your private key(s) is yours, the user.

 

Accuracy of data

We strive to ensure that all your data is always available. At times, we leverage some cache mechanisms on our platform at various levels. In an unlikely event, technical, typographical, or photographic errors may still appear on the platform after being addressed or updated. With the continuous improvements and changes we are making to the Unistry platform to ensure we are giving our users the best tool(s) for the job, we do not warrant that any of the data on our platform at a particular time is 100% accurate, complete or current. Unistry may change the data on its platform or its representation at any time without notice.

User data

Any personal information collected from you, the User, will be securely held and processed in accordance with local law and will never be shared with or sold to third parties.

 

You agree to allow us to send you important notifications via email to the email address we have on record for you. You can opt out from these at any time.

 

We use your information to provide, build, protect, improve, and promote our platform. The way we use your information depends, in part, on how you use our platform and what preferences you set.

 

We use your information for the following specific purposes:

  • • Personalising Unistry for you. We use personal information to tailor your Unistry experience and enhance your command line experience. For example, the experience of the CLI will be catered to you.
  • • Providing support to you. We need personal information to resolve issues that you encounter with our platform. For example, if you need help with an issue or implementation detail, we may need access to account information in order to respond to your request.
  • • Troubleshooting and debugging our platform. We need data to resolve technical issues that arise with our platform. For example, we use log data to track outages.
  • • Building and improving our products. We’re continually developing new methods to make our products more seamless, faster, more secure, and more helpful. We use data to help us do so.
  • • Processing payments. If you are a paying customer, we need payment information to enable your transaction.
  • • Promoting our products. We use data to send promotional communications. For example, depending on your location, we may use account information to send you marketing emails about new products or offers.
  • • Ensuring our and our users’ safety and security. We need personal information to protect Unistry against fraud and abuse. For example, we may need to use your account information to verify your activity and protect against malicious, deceptive, or illegal activity.
  • • Supporting and selling our products. We use sales and support data to promote and sell our products to you and to provide you with support. Some of these activities are provided by service providers with whom we have contracted.
  • • Complying with legal obligations. We use personal information where required by law or where we believe it is necessary to protect our or other’s legal rights. For example, we may process account information to help you exercise your data protection rights.

We use automated and manual processing techniques when using information for these purposes. 

 

Subscription Trials plan

Unistry provides trial plans for individual consumers, at no charge, that are new to the platform. These trials are designed to familiarise you with the platform and offerings to see if you can utilise our ever-growing features.

 

Once the trial is completed, if you do not explicitly cancel your subscription, we will accept that you are happy to pay the subscription to continue using the Platform and Data.

 

Payment

By selecting a paid plan you agree to pay Unistry the monthly or annual subscription fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up for a paid plan and will cover the use of that service for a monthly or annual subscription period as indicated. You represent and warrant that you are authorised, or have the permission of the authorised signatory of the credit card or charge card provided to Unistry, to pay any fees incurred from use of the platform.

 

Unless you notify Unistry before the end of the applicable subscription period that you want to cancel a paid account, your paid subscription will automatically renew, and you authorise us to collect the then-applicable annual or monthly subscription fee (as well as any taxes) using any credit card or other payment mechanism we have on record for you. If you exhaust the allocation of Commands included in your plan, you authorise us to collect the then-applicable fee (as well as any taxes). We will use any credit card or other payment mechanism we have on record for you in exchange for another block of allocated Commands. Paid plans can be cancelled at any time in the Profile section of the web app.

 

If your number of commands stored on the platform exceeds your authorised allocation included in your plan, and the additional allocation block is not covered, we will notify you and then systematically clean up from your oldest commands to ensure you stay within your account limitations. Purchased extra allocation of Commands blocks will rollover as long as payment is authorised.

 

Refund and cancellation policy

You may cancel your monthly or annual subscription at anytime.

Copyright infringement

If you believe that your own copyrighted work is accessible on the platform in violation of your copyright, you may provide our Designated Agent with a written communication as set forth in the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512(c)(3) that contains the following written information:

 

A description identifying in sufficient detail the copyrighted work or intellectual property that you claim has been infringed so it may be accurately located using the URL. Where multiple works are at issue please provide a list of URLs or sufficient information to locate the alleged infringing material.

  • • An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest;
  • • A statement by you that you have a good-faith belief that the disputed use is unauthorised by the copyright owner, its agent, or the law;
  • • A statement by you made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner’s behalf.
  • • Also include your name, mailing address, telephone number and email address.

 

Disclaimer of warranties

The parties acknowledge that the Unistry platform, Content and any services are provided “AS IS.” EXCEPT FOR BODILY INJURY, COMPANY AND ITS LICENSORS DISCLAIM ALL WARRANTIES RELATING TO THE PLATFORM OR ANY SERVICES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES AGAINST INFRINGEMENT OF THIRD-PARTY RIGHTS, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

 

Indemnification

You will indemnify and hold Unistry harmless against any third party claims, liabilities or expenses incurred (including reasonable attorneys’ fees), as well as amounts finally awarded in a settlement or by a court arising from any claim or allegation by a third party arising out of (i) allegations that Customer’s usage of the Unistry platform infringes or misappropriates any trademark, copyright or other intellectual property of any third party, (ii) the Unistry platform services that are combined with any Customer product, process or materials where the alleged infringement relates to such combination; (iii) Customer’s use of a version of the Unistry platform services other than the version that was current at the time of such use; or (iv) your breach or alleged breach of any of your obligations or representations under this Agreement.

 

Limitations

In no event shall Unistry be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Unistry platform, even if Unistry’s authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

 

Modifications

Unistry may revise these terms of service for its platform at any time without notice. By using this platform, you are agreeing to be bound by the then-current version of these terms of service.

 

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom, and you irrevocably submit to the exclusive jurisdiction of the courts in this location.
